2. Who this policy applies to

This policy applies to all persons who:

• visit the FulgerHost website;
• create a customer account;
• place orders or use FulgerHost’s services;
• contact us by email, phone, the ticketing system, live chat or Discord;
• subscribe to the newsletter or receive marketing communications, provided they have given their consent.

3. What is personal data?

Personal data means any information relating to an identified or identifiable natural person, whether directly or indirectly.

Depending on the specific situation, we may process data such as:

FulgerHost may transfer personal data, strictly to the extent necessary, to:

• payment processors and financial services providers;
• providers of technical, support, security, infrastructure and communications services;
• partners involved in order processing, service delivery or tax and accounting compliance;
• consultants, accountants, solicitors or other service providers involved in our business, to the extent necessary.

Depending on your interactions with our platform, we may also use external services such as:

• Google Analytics 4 – traffic analysis and statistics;
• Talk to me. – live chat support;
• Stripe / PayPal / Skrill / paysafecard / Banca Transilvania – payment processing;
• WHMCS – managing customer accounts, orders and invoices;
• ContApp – issuing invoices and keeping the accounts;
• Google Workspace – email communication and operational management;
• Google reCAPTCHA – anti-abuse protection and form security.

FulgerHost also uses hosting infrastructure, backup facilities and technical services provided by partners within the European Union and, where applicable, outside the European Union, subject to appropriate safeguards. Data is not disclosed publicly, and access to it is restricted to what is necessary for the operation and security of the services.

8. Verification of identity and accuracy of data

The personal details provided when placing an order must be genuine, accurate and complete.

In certain situations, to prevent fraud or to verify an order, we reserve the right to request additional documents or information to verify your identity.

Failure to provide the strictly necessary information may result in the suspension or cancellation of the order, or in our being unable to provide the service.

9. International data transfers

Certain service providers used by FulgerHost may process data outside the European Economic Area. In such cases, we ensure that there is a valid legal basis and appropriate safeguards in place, in accordance with the applicable legislation.

10. How long do we keep the data?

In the absence of any legal obligation or legitimate interest requiring otherwise, we consider the following indicative timeframes:

• inactive accounts: until a request for deletion is made or until there is no longer a legitimate basis for retaining them;
• vouchers: approximately 6 months;
• invoices and accounting documents: in accordance with legal requirements;
• logs: approximately 6 months;
• Backups: until the service is cancelled or deleted, or in accordance with the applicable technical cycles.

13. People under the age of 18

FulgerHost’s services are primarily intended for individuals who are legally capable of entering into contracts. Minors may only use or purchase services with the consent of a parent or legal guardian.

We take reasonable technical and organisational measures to protect data against unauthorised access, loss, destruction or unauthorised disclosure. However, no system can guarantee absolute security.
